Three authors have filed a lawsuit against Nvidia (NVDA.O), whose chips enable artificial intelligence, alleging that the company used their protected by copyright books without their consent to train its NeMo, navigates new tab AI platform.
The works of Brian Keene, Abdi Nazemian, and Stewart O’Nan were removed in the month of October “due to claims of copyright infringement.” The dataset, which included roughly 196,640 books, was used to train NeMo to mimic ordinary written language.

The authors said that Nvidia “admitted” that it developed NeMo on the data set, thereby infringing on their copyrights, and that this is why the takedown occurred in the suggested class action that was submitted on a Friday night in federal court in San Francisco. For individuals in the US whose copyrighted works were used to train NeMo’s “big language models” over the previous three years, they are suing for unspecified damages.
Three novels are included in the lawsuit: Keene’s 2008 book “Ghost Walk,” Nazemian’s 2019 book “Like a Love Story,” as well as O’Nan’s 2007 novella “Last Night on the Lobster.” On Sunday, Nvidia declined to comment. Requests for further comment on Sunday were not immediately answered by the writers’ solicitors.
The lawsuit involves Nvidia and generative AI, which generates new content from inputs like text, images, and sounds. It is part of an increasing number of lawsuits filed by writers and the New York Times regarding this technology. NeMo is promoted by Nvidia as a quick and inexpensive way to use generative AI.
Several other businesses have been sued in relation to this technology, including Microsoft (MSFT.O) and OpenAI, the creators of the AI platform ChatGPT. Investors now favour Nvidia due to the growth of AI. With a nearly 600% increase in stock price since the end of 2022, Nvidia, a chipmaker based in Santa Clara, California, is now valued at nearly $2.2 trillion. Nazemian et al v. Nvidia Corp. is the case in question; it is No. 24-01454 in the U.S. District Court for the Northern District of California.
